PURCHASES / ORDERS TERMS AND CONDITIONS

To use and place an order on this website you must be over 18 years of age.  This includes to place an order, to register an account or to sign up to our email communications.

The information provided on this website is for guidance and information only and should not take the place of a diagnosis by your general practitioner or professional advice of your  pharmacist.

Terms

Whites  Pharmacy is a trading name of Oakpark Pharmacies Ltd, a company registered in Ireland under registration number 588604. Our registered company address is Oakpark Pharmacies Ltd, T/A Whites Pharmacy, 44 Tullow Street, Carlow.

Arthur Kennedy Chemist Ltd’s registered address is Main Street, Hacketstown, Co. Carlow and is registered under registration no 75785.

Our Pharmacies only sells 100% genuine products.  All images and videos are for illustration purposes only and may not be the exact bottle received. Please check full product details for packaging and description. All stock and prices are subject to availability .All prices are in Euro (€) and include VAT.

Please check your order details carefully before submitting your order as changes cannot be made to your order once it has been placed and we will not grant any compensation in any form for inconvenience experienced as a result.

The delivery cost for your purchase is displayed when you select the delivery method at the checkout. You can still choose to cancel the order at this stage. Parcels with a total weight of up to 10Kg will be delivered or you can collect at one of our stores. Parcels of over 10kg will only be available for collection in store. Otherwise, please contact the Pharmacy to arrange an alternative delivery method.  Refunds on items returned will be offered at the price paid at the time of purchase. Therefore, items bought on special offer will only be refunded at the special offer price. All complaints will be acknowledged within 7 working days, although we try to acknowledge all complaints immediately. The customer will be informed of all progress.

According to the Data Protection Act 1988 we do not supply any of your details to a third party, unless you have given express permission to do so. Orders may be subject to extra security checks at our discretion. This may include confirmation of Credit/Debit card details and full address details. We reserve the right to cancel any orders if this information cannot be supplied. We reserves the right to deliver certain orders to the Billing Address only. Customers will be notified by email if this is the case. If we have insufficient stock to deliver the goods ordered by you, we will notify you as soon as possible to either offer an alternative item (to the same value) or we will credit your card for the cost of the unavailable goods. We will not be obliged to offer any additional compensation for disappointment suffered.

Discount Codes

Discount codes exclude sale items, electrical, cameras, passport photos & photo, OTC medicines, gift cards, baby food and Prescriptions. You must be logged in your account to use a discount code. Only one discount code can be used at any one time and cannot be used in conjunction with a loyalty card. 

All offer codes are applied to the value of the order, excluding delivery costs and are subject to our general Terms and Conditions.

The offer code must be entered in to the Voucher Code field on the basket page and applied for the discount to be deducted from the order.

Unless stated discounts cannot be combined and only one offer can be applied to any order.

Items already reduced in price, displaying a 'Was' and 'Now' price are also excluded from discount code offers.

Offers can be amended or withdrawn at any time.




Order & Returns Policy

Orders returned by the courier as not picked up will be refunded the cost of products upon receipt, not including postage. Customers will be notified and the order will be cancelled. The customer will then have to re-order the goods if they are still required. If an order is not received, you must contact us within 14 days of dispatch as no claim can be made after this time. We cannot be held responsible for any delay in delivery, or any damage caused to your purchase once the package has been dispatched to the courier and a dispatch acknowledgement has been emailed to your specified email address. In the rare event of a customer receiving an incorrect order, we will, upon receipt of the returned incorrect item, send the correct item and refund the return postage. If the customer requires a fast replacement, we will recharge the customer, send the correct item and on receipt of the returned item, refund the customer for the cost of their second order and for their return postage. None of the above affects your statutory rights.

Availability

All products on the website are subject to availability. In the unlikely event that a product for sale online has become out of stock or unavailable, we will notify you directly via Email or phone to offer you a replacement or full refund of the price of the item.

Please read these terms of use carefully before you start to use the Site. By using the Site, you indicate that you accept these terms of use and that you agree to abide by them. If you do not agree to these terms of use, please refrain from using the Site.

INFORMATION ABOUT US

1. The Site is operated by Oakpark Pharamacies Ltd, T/A Whites Pharmacy and Arthur Kennedy Chemist Ltd  (the company) which are registered in the Republic of Ireland.

ACCESSING THE SITE

2. Access to the site is permitted on a temporary basis, and the company reserves the right to withdraw or amend the service it provides on the site without notice (see below). The company will not be liable if for any reason the site is unavailable at any time or for any period. From time to time, the company may restrict access to the entire site or to some parts of it, to users who have registered with the site. If you choose, or you are provided with, a user identification code, password or any other piece of information as part of security procedures, you must treat such information as confidential, and you must not disclose it to any third party. The company has the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in the company’s opinion you have failed to comply with any of the provisions of these terms of use.

You are responsible for making all arrangements necessary for you to have access to the site. You are also responsible for ensuring that all persons who access the site through your internet connection are aware of these terms, and that they comply with them.

INTELLECTUAL PROPERTY RIGHTS

3. The company is the owner or the licensee of all intellectual property rights in the site, and in the material published on it. Those works are protected by copyright and other laws and treaties around the world. All such rights are reserved. You may print off one copy, and may download extracts, of any page(s) from the site for your personal reference and you may draw the attention of others within your organisation to material posted on the site.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. The company status (and that of any identified contributors) as the author of material on the site must always be acknowledged.

You must not use any part of the materials on the Site for commercial purposes without obtaining a licence to do so from the company or its licensors. If you print off, copy or download any part of the site in breach of these terms of use, your right to use the site will cease immediately and you must, at the company’s option, return or destroy any copies of the materials you have made.

Commentary and other materials posted on the site are not intended to amount to advice on which reliance should be placed.  The company therefore disclaims all liability and responsibility arising from any reliance placed on such materials by any visitor to the site, or by anyone who may be informed of any of its contents.

5. The Company aims to update the site regularly, and may change the content at any time. If the need arises, the company may suspend access to the site, or close it indefinitely. Any of the material on the site may be out of date at any given time, and the company is under no obligation to update such material.

OUR LIABILITY

6. The material displayed on the site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, the company, other members of the group of companies and third parties connected to the company hereby expressly exclude:

6.1 all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity; and

6.2 any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with the site or in connection with the use, inability to use, or results of the use of the site, any websites linked to it and any materials posted on it, including, without limitation any liability for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

7. The company processes information about you in accordance with its privacy policy. By using the site, you consent to such processing and you warrant that all data provided by you is accurate.

TRANSACTIONS CONCLUDED THROUGH THE SITE

8. Contracts for the supply of products formed through the site or as a result of visits made by you are governed by the company terms and conditions of online trading.

LINKING TO THE SITE

9. You may link to the company’s home page, provided you do so in a way that is fair and legal and does not damage the company’s reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on the company’s part where none exists. You must not establish a link from any website that is not owned by you.

The Site must not be framed on any other site, nor may you create a link to any part of the site other than the home page. The company reserves the right to withdraw linking permission without notice.

10. Where the Site contains links to other sites and resources provided by third parties, these links are provided for your information only. The company has no control over the contents of those sites or resources, and accepts no responsibility for them or for any loss or damage that may arise from your use of them.

VARIATIONS

11. The company may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes the company has made. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on the site.

Gift Voucher Terms & Conditions

  1. Gift Vouchers are redeemable against any merchandise in the pharmacy specified.
  2. Gift Vouchers cannot be used to purchase Gift Vouchers.
  3. Multiple Gift Vouchers may be redeemed in the same transaction up to the value of the goods being purchased.
  4. Gift Vouchers cannot be exchanged for cash.
  5. Gift Vouchers must be submitted upon redemption in store.
  6. Gift Vouchers will expire in 60 months from the date of purchase stated on the Voucher. Gift Vouchers presented after their expiry date will be treated as void and are non-exchangeable and non-refundable.
  7. Please treat Gift Vouchers as cash in terms of security. Gift vouchers cannot be replaced if lost, stolen or damaged.
  8. The company reserves the right to refuse to accept a Gift Voucher which it deems to have been tampered with, duplicated, and damaged or which otherwise is suspected to be affected from fraud.
  9. The company reserves the right to change any of these terms and conditions from time to time without notice and to take appropriate action including cancellation of the voucher if, at its discretion, it deems such action necessary
